Srinagar, Apr 27 : The High Court of Jammu & Kashmir and Ladakh has quashed the detention of Aam Aadmi Party MLA Mehraj Malik under the Public Safety Act (PSA), granting relief to the legislator who had been in preventive custody since September last year.
Malik, who represents Doda constituency, was detained on September 8, 2025, under the PSA on allegations related to public order. He was initially lodged in Bhaderwah jail and later shifted to Kathua district jail.
Challenging the detention, Malik approached the High Court through a habeas corpus petition, stating that the order was arbitrary and violated his legal rights.
After hearing the matter, the High Court of Jammu & Kashmir and Ladakh set aside the detention order, holding that the grounds for invoking the PSA were not sustainable under law.
With this order, the court has cleared the way for Malik’s release from preventive custody.
The case had drawn attention as it involved the detention of a sitting MLA under the PSA in Jammu and Kashmir. Further details of the court’s judgment are awaited.(KNS)
