J-K Govt notifies enhanced family pension for retired employees

Srinagar, Jul 21: The Jammu and Kashmir government has amended the Family Pension-Cum-Gratuity Rules, 1964, to provide enhanced family pension to dependents of retired government servants for a maximum period of seven years or till the deceased would have turned 67, whichever is earlier.

An official notification issued by the Finance Department’s Codes Division accessed news agency Kashmir News Service (KNS) said the new provision has been added as a second proviso below Note 4 of Rule 20 of the rules contained in Schedule XV of the Jammu and Kashmir Civil Service Regulations, Vol. II.

“In the event of death of a Government servant after retirement, the family pension at enhanced rates shall be payable for a period of seven years, or for a period up to the date on which the retired deceased Government servant would have attained the age of sixty-seven years had he survived, whichever is less,” the order read.

The notification, issued in exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, was issued on the directions of Lieutenant Governor, it added.

The government clarified that cases already settled under the existing rules shall not be reopened. However, pending cases on the date of issuance of the notification shall be decided in accordance with the new amendment. (KNS)
